These disclosures of abusive acts and actions of HOA boards and management firms is necessitated by the repeated failure of government officials to protect that faction, that segment of society, living under the authoritarian rule of homeowners associations from violations of the laws and the governing documents by another faction, the HOA board supported by its attorneys. Perhaps, disregarding that
statement made at the Arizona HOA Interim Committee hearing in 2000 that "We
don't want to hear anymore horror stories", the legislators,
upon reading these unconscionable actions by HOAs and their management firms,
will act "to establish justice, insure domestic tranquility . . . and
promote the general welfare." The cases were selected from email contacts sent to AHLIS over the years, and represent either intentional acts or acts of negligence, equally reprehensible, in violation of statutes, governing documents and a director's duty of good faith, and prudent person obligations on behalf of the HOA, that is the people, and not some legal creation devoid of obligations to its members. These acts and actions do not reflect good government entitled to a laissez-faire, hands-off regulation and unaccountability to the state. |
