I am hoping with all your experience (reviewed your website) you can give me some good advise. All of

what you said is so true and from reading I am sure you can feel my pain.

This gate allowed for the board to make new rules. One must be up to date on fees in order to drive in

the common areas, they owner must provide a copy of their vehicle registration, social security card,

drivers license, copy of their deed,and a telephone bill with the owners name on it (if they would like to

be able to have telephone access to allow their guest to enter the gate.

Recommendation

This is a serious infringment on your right to privacy! Read your laws on privacy, and constitutional

protections. You know that your ss nbr is confidential, and your deed and phone bill are irrelevant. You

can tell the board that asking for such information can lead to suits against them for release of any

confidential and private information, and $$$ damages and penalties can be assessed personally against

I am wondering if you can help me. I have a question pertaining to HOA sub committee's. In our

Association we have numerous subcommittees one being an architectural committee. I asked to become

a member and they said they had enough members. I asked to observe the meetings, they stated they

are private closed meetings. I asked why and they could not provide me with an answer. There is nothing

that states in the sub committees structure that you can or can not observe. I asked if they would publish

information on what is being submitted and if HOA members could send email stating their objections,

once again I was denied.

Recommendation

ARS 33-1804. Open meetings; exceptions

A. Notwithstanding any provision in the declaration, bylaws or other documents to the contrary, all

meetings of the association and board of directors are open to all members of the association or any

person designated by a member in writing as the member's representative and all members or designated

representatives so desiring shall be permitted to attend and speak at an appropriate time during the

deliberations and proceedings. The board may place reasonable time restrictions on those persons

speaking during the meeting but shall permit a member or member's designated representative to speak

before the board takes formal action on an item under discussion in addition to any other opportunities to

speak. The board shall provide for a reasonable number of persons to speak on each side of an issue. Any

portion of a meeting may be closed only if that closed portion of the meeting is limited to consideration

of one or more of the following:









Now, they will argue that this is a sub-committee meeting and the above doesn't apply. Ask them just

what a sub-committee is, if not a subsidiary meeting of a few for a specific topic. This applies even if the

term "sub-committee" is not used in your governing documents. See Corporation law and statutes that

govern.
